Our Services, including all Artificial Intelligence (AI) Voice Agents, are provided on an "AS IS" and "AS AVAILABLE" basis. You acknowledge that AI voice systems are probabilistic in nature and may occasionally produce unexpected responses, produce hallucinations, or experience technical interruptions such as dropped calls. Except as expressly provided herein, dotflow.bot makes no guarantees regarding specific performance outcomes, lead volumes, or revenue increases.

3. Limitation of Liability

UNDER NO CIRCUMSTANCES SHALL DOTFLOW.BOT, ITS OWNERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. This includes, but is not limited to, loss of profits, loss of data, loss of leads, reputational damage, or business interruption arising from the use or inability to use our AI agents. Our total liability for any claim arising out of these terms shall never exceed the amount you paid us in the previous one (1) month of service.

4. Intellectual Property

All code, designs, frameworks, prompts, methodologies, and architectures behind dotflow.bot's Voice Agents are the exclusive property of dotflow.bot. You are granted a limited, non-exclusive license to use the configured agent solely for your business during the term of your active subscription. You may not reverse engineer, copy, or resell the technology.

5. Customer Responsibilities and Indemnification

You agree to use our Services strictly for lawful purposes. You are solely responsible for compliance with all local, state, and federal laws regarding telemarketing, recording consent, and communication regulations (e.g., TCPA, LGPD, GDPR). You agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS dotflow.bot from any claims, lawsuits, fines, or damages arising out of your use of our AI Voice Agents.

6. Payments, Subscriptions, and Refunds

All payments are final. There are absolutely NO REFUNDS under any circumstances, including dissatisfaction with the AI's performance, unless strictly mandated by applicable law. We reserve the right to suspend or terminate your service immediately if payments are delayed or disputed.

7. Termination

We reserve the absolute right to suspend or terminate your access to the Services at any time, for any reason, with or without notice, and without incurring any liability.

8. Governing Law and Jurisdiction

These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the State of Texas, USA, without regard to its conflict of law principles. Any legal action or proceeding related to your access to, or use of, the Services shall be instituted in a state or federal court in Texas.

9. Dispute Resolution and Arbitration

Any dispute arising out of or relating to these Terms shall be settled by binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. The site of arbitration shall be Texas, USA. You agree that any dispute resolution will be conducted only on an individual basis and not in a class, consolidated, or representative action.
